Conditions of participation in guided cycling tours with BAMBERG & RAD (Proprietor: Norbert Hetz)
1. General Information
- Your physical health and fitness should be at a level which allows you to participate safely in your chosen tour.
- Minors taking part in the tours must be accompanied by a parent or guardian at all times.
2.Safety Notice
- In the interest of the safety of all participants, participants must follow the instructions of the tour guide at all times and must exercise due care and attention when cycling.
- Participants may not leave the group without informing the tour guide.
- The tour guide reserves the right to exclude participants who fail to follow the guide's instructions or who are unfit or unable to participate safely in the tours. Participants may also be excluded if their bicycles are not in a safe, legal and rideable condition.
3. Liability
- Cyclists must accept responsiblity for their own actions. Participants take part in all tours at their own risk.
- BAMBERG & RAD and its proprietor Norbert Hetz (or individual staff members, as applicable) can only accept liability for any possible damage to life, body or health resulting from wilful intent or negligence and not caused by other participants or third parties. BAMBERG & RAD and its proprietor Norbert Hetz (or individual members of staff, as applicable) can only accept liability for other damages if these were caused intentionally or through gross negligence.
- No liability will be accepted by the tour organizer or the tour guide in cases where traffic regulations or instructions given by the tour guide have been contravened.
- No liability will be accepted for damage to personal equipment and for damage resulting from hazards created by participants or third parties.
4. Cancellation of Tours
- In the event of a tour being cancelled or not taking place, participants are entitled to a full refund. No further claims will be entertained.
- If a tour is abandoned after it has started, claims will only be entertained if the interruption arose as a result of a deliberate act or as a result of negligence on the part of the organizers.
5. Severability
Should any of the terms and conditions of this agreement be held to be invalid, unlawful or unenforceable, such terms and conditions will be made severable from the remaining terms and conditions, which will continue to be valid and enforceable. If any term or condition held to be invalid is capable of amendment to render it valid, the parties agree to negotiate an amendment to remove invalidity. This shall also apply to unintended omissions, if any. The English translation of our terms and conditions is provided for your convenience only. Only the original German—language version is legally binding.
